How Long Does a Patent Last?

Documents You Will Need

Patent filing needs more paperwork than most other registrations. Here's what's usually required.

  1. Application Form (Form 1) Basic details about you and your invention.
  2. Specification A full write-up of how your invention works — a "provisional" one now, and a "complete" one within 12 months.
  3. Claims Exact statements about what you want protected.
  4. Abstract A short summary, usually under 150 words.
  5. Drawings If they help explain your invention.
  6. Statement Form (Form 3) Telling the office about any similar filings abroad.
  7. Inventor Declaration (Form 5) Confirming who actually created the invention.
  8. Power of Attorney If an agent is filing for you.
  9. Patent Search Report Not required, but a smart idea, to check your idea is truly new.
  10. Proof of Rights If you're not the inventor but the owner (like a company).
  11. Priority Document If you already filed this idea in another country.
  12. Fee Receipt Showing you've paid.
