Design Registration

1. Scope of Protection

Design registration covers the aesthetic aspects of a product, such as its shape, pattern, color, and surface ornamentation. It does not cover the functional aspects or technical features of the product.

2. Eligibility

The design must be new, original, and not previously disclosed to the public before the registration application. It should have an industrial application, meaning it is used in an industrial or commercial process.

3. Application Process

• Prepare and File: Submit an application with detailed representations or drawings of the design. Provide information about the design, including its title and a brief description.
• Examination: The design application is examined for originality and compliance with legal requirements.
• Publication: Once approved, the design is published in the Design Journal to allow any third parties to object.
• Registration: If no objections are raised, or objections are resolved, the design is registered, and a registration certificate is issued.

4. Rights Granted

The registered design owner has the exclusive right to use, license, and enforce the design. This means others cannot manufacture, sell, or use the design without permission.

5. Duration

Design registration typically lasts for a specific period, such as 10 years, with the option to renew for additional terms.

6. Enforcement

If someone infringes on the registered design, the owner can take legal action to prevent unauthorized use and seek remedies such as damages or injunctions.
